Terms of Use — Kanji Creature Cards

1. Introduction

These Terms of Use (the "Terms") govern your use of Kanji Creature Cards (the "App"), published by an individual developer, doing business as DORAYA. The App is distributed in 145 countries and regions. It is not available in the member states of the European Union, in Russia, in Belarus, or in mainland China.

These Terms work together with the Privacy Policy, which explains how the App handles information. By using the App, you accept both documents.

Note: The App is made and operated by one person, doing business as DORAYA. Email is the contact channel; no personal name or postal address is published. The governing law clause in Section 11 reflects the Provider's current direction (Japanese law, with the mandatory consumer protection rights of the user's own country preserved). Legal review remains recommended before public release.

2. Acceptance of Terms

By installing, opening, or using the App, you confirm that:

• You have read and understood these Terms and the Privacy Policy.
• You agree to use the App in accordance with these Terms.
• You meet the eligibility requirements set out in Section 4.

If you do not agree with any part of these Terms, please do not install or use the App.

3. The App and Its Use

3.1 What the App Is

The App is a short runner game called KANJI RUN. Before each run you draw three kanji; each kanji shapes ten seconds of a thirty-second run. You run as a spirit character, may bring one charm into a run, and can discover new spirits by finishing a run with a particular pair of kanji. All text is presented in English.

3.2 MVP Scope

The MVP release of the App covers:

• A fixed set of four kanji (wind, moon, mountain, night), each with one run effect
• Two spirits (Mochi, available from the start, and Tsukiyo, discovered in play), each with its own stats and special move
• Two charms (Guard and Rush). Each can be tried free for three runs. On iOS, a permanent unlock is offered as an optional one-time in-app purchase (see Section 3.4). On Android, the unlock is not yet available. The game, its spirits and their special moves are playable in full without any charm
• Local-only progress (best score, discovered spirits, choices) stored on your device
• No advertising, no third-party tracking, no subscriptions. The only in-app purchases are the optional one-time charm unlocks described in Section 3.4

Future releases may expand fields, add seasonal content, add further charms, or add other features. Such changes will be reflected in updated versions of these Terms and the Privacy Policy.

3.3 Languages and Regions

• The App is currently available in English only.
• The App is distributed in 145 countries and regions. It is not available in the member states of the European Union, in Russia, in Belarus, or in mainland China.
• Distribution may expand to other regions in the future. Such expansion will be announced through the App Store and Google Play listings.

3.4 In-App Purchases (iOS)

On iOS, each charm can be unlocked permanently through an optional in-app purchase. These purchases work as follows:

• Type: a one-time, non-consumable purchase. There are no subscriptions, no consumable items, and no expiry.
• Price: shown by the App Store, in your local currency, at the moment you decide to buy. The App itself does not set or display any other price.
• Payment: processed entirely by Apple through your Apple Account under the Apple Media Services Terms and Conditions. DORAYA does not receive your payment details.
• Delivery: the charm is unlocked only after Apple confirms the purchase. If the purchase is pending (for example, Ask to Buy), the charm stays locked until it is approved.
• Restore: purchases are tied to the Apple Account used to buy them. After reinstalling the App or switching devices, use Restore Purchases in the unlock screen to restore your charms at no charge.
• Refunds: refund requests are handled by Apple under Apple's policies, not by DORAYA.
• No obligation: every run, spirit, and special move is playable in full without buying anything. A charm changes how one run plays; it is not required to progress.

On Android, charm unlocks are not yet available in this version; only the free trials are offered.

4. Eligibility

The MVP release of the App is intended for users aged 13 and over as the store age rating. The final store age rating will be confirmed during App Store and Google Play submission.

If you are below the minimum age set by the applicable store rating in your country, please do not use the App.

Store age rating and GDPR Article 8 consent age are separate concepts:

• The store age rating (13+) is the minimum age set by the App Store and Google Play for downloading and using the App.
• The GDPR Article 8 consent age (which governs the processing of personal data) varies by country (13 to 16 years under the GDPR, and 13 under the UK GDPR). Because the MVP release of the App does not process personal data, GDPR Article 8 consent does not apply to the App itself. See the Privacy Policy §7 for further detail.

5. Your Use of the App

5.1 Permitted Use

You may use the App for your personal, non-commercial enjoyment, in line with the App's intended purpose (collecting kanji-spirit cards).

5.2 Restrictions

You agree not to:

• Reverse engineer, decompile, or disassemble the App, except to the extent allowed by applicable law (for example, where the law permits decompilation for the limited purpose of interoperability).
• Use automated scripts, bots, or other software to interact with the App in a way that interferes with its intended use.
• Attempt to gain unauthorized access to any DORAYA system, account, or data outside of the App's intended functionality.
• Use the App in a way that violates applicable law in your country of residence.

5.3 Updates and Availability

DORAYA may release updates to the App through the App Store and Google Play. Updates may be required to keep the App functioning correctly. DORAYA may, at its discretion, withdraw the App from one or more regions, for example to comply with legal requirements or to retire an older version. Where possible, DORAYA will announce withdrawals through the relevant store listing.

6. Intellectual Property

6.1 Publisher's Rights

The App, including its source code, visual design, text content, kanji-spirit characters, illustrations, sound effects (if any are added later), and brand elements, is owned by DORAYA (or licensed to DORAYA). Nothing in these Terms transfers ownership of these elements to you.

The App and these Terms do not grant you any right to:

• Distribute, sublicense, or sell the App or any part of it.
• Use the App's name, logo, kanji-spirit character designs, or other brand elements in a way that suggests endorsement or partnership without DORAYA's prior written consent.

6.2 Your Local Data

Your best score, discovered spirits, and any other data the App stores on your device belong to you. The App does not transmit this data to DORAYA's servers in the MVP release. You can clear this data at any time through the App's Settings or by uninstalling the App (see the Privacy Policy for full details).

6.3 Feedback

If you voluntarily send feedback, comments, or suggestions to DORAYA (for example, by email or through community channels), DORAYA may use that feedback to improve the App without further obligation to you. This does not give DORAYA any claim over the personal information in your feedback beyond what the Privacy Policy describes.

7. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied.

To the maximum extent permitted by applicable law, DORAYA does not warrant that:

• The App will be uninterrupted, error-free, or free of vulnerabilities.
• Local data stored by the App will always survive device events such as operating system updates, restoration from backups, or storage failures.
• The App will meet your specific expectations or requirements.

This Section does not exclude or limit any warranties that cannot be excluded or limited under applicable law (for example, certain consumer protections in your country of residence).

8. Limitation of Liability

The App is provided free of charge as part of the MVP phase. Because there is no paid amount that could serve as a reference point, the MVP release of these Terms does not assert a monetary liability cap.

To the maximum extent permitted by applicable law, DORAYA is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or business interruption, arising from your use of or inability to use the App.

Any limitation of liability set out above applies only to the extent permitted by mandatory consumer protection law in the user's country of residence.

This Section does not exclude or limit DORAYA's liability for:

• Death or personal injury caused by DORAYA's negligence.
• Fraud or fraudulent misrepresentation.
• Any liability that cannot be excluded or limited under applicable law.

9. Termination

9.1 By You

You may stop using the App at any time by uninstalling it from your device.

9.2 By DORAYA

DORAYA may suspend, restrict, or end your access to the App, in whole or in part, if:

• You materially violate these Terms.
• Continued operation is no longer commercially or legally feasible for DORAYA.
• A regulatory or legal requirement forces DORAYA to do so.

Where reasonably possible, DORAYA will provide advance notice of termination, for example through the store listing or an in-app message.

9.3 Effect of Termination

On termination, these Terms (other than provisions that by their nature should survive, such as intellectual property and limitation of liability) stop applying to your use of the App. Local data on your device remains yours and can be removed by uninstalling the App.

10. Changes to These Terms

DORAYA may update these Terms from time to time, for example when:

• New features are added or removed from the App.
• A new region is added or removed from the distribution list.
• Applicable law or store policy changes require it.

When DORAYA updates the Terms:

• The Last Updated date at the top of this document will be revised.
• If the changes are material, DORAYA will provide notice through an app update or the relevant store listing.
• The updated Terms will be available at the same URL where this document is hosted.

Your continued use of the App after the changes take effect means you accept the updated Terms. If you do not accept the updated Terms, please stop using the App and uninstall it.

11. Governing Law and Disputes

These Terms shall be governed by the laws of Japan, without prejudice to any mandatory consumer protection rights you have under the law of your country of habitual residence that cannot be set aside by agreement. The App is made and operated by one person, doing business as DORAYA.

Disputes arising out of or in connection with these Terms shall be resolved before the competent courts, subject to the mandatory consumer protection law applicable in your country of residence. You keep the right to use any consumer redress or alternative dispute resolution (ADR) mechanism that may be available to you under that law.

Draft note: The App is not distributed in the European Union, so EU-specific redress routes are not listed here. (The EU Online Dispute Resolution platform was in any case discontinued in 2025 under Regulation (EU) 2024/3228.) ADR institutions in the countries where the App is distributed are not enumerated in this MVP draft; references may be added during the public release preparation phase after legal review.

Note: Legal review is recommended before public release to confirm the final wording.
